settlement agency when purchasing from an REO seller. Never choose the
settlement agent selected by the bank as the seller. That settlement

Tucker's Tips encountered a closing situation where the REO selling bank had
prepared the new deed based on the deed description from three owners
prior! Needless to say, the "Being" clause and the deed were
completely wrong. In this case Settlement was not delayed because the
closing paralegal on the purchaser's side spotted the discrepancy while
reviewing the proposed deed and comparing it to the property description in the
title work and binder. (Had the purchaser selected the bank's settlement
agent, this error would have gone undiscovered as the bank's settlement agent
prepared the incorrect deed.)<o:p></o:p></span></div>

1, 2015, the TILA-RESPA Integrated Disclosure Rule from the Consumer Financial
Protection Bureau becomes effective. What will it mean for lenders, realtors,
consumers and the closing process? <o:p></o:p></span><br />

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">This new
rule, which applies to most closed-end consumer credit transactions secured by
real property, is designed to streamline the currently required four disclosure
forms, originally developed by two different Federal agencies into two, more
user friendly forms. The Good Faith Estimate and the initial
Truth-in-Lending disclosure have been combined into a new form: the <b>Loan
Estimate</b>. The HUD-1 and final Truth-in-Lending disclosure have also been
combined into a new form: the <b>Closing Disclosure</b>. Mortgage brokers and
lenders, who receive a new application for such a transaction on or after
August 1, 2015, must provide the new Integrated Disclosure forms.<o:p></o:p></span></div>

changes could result in significant delays to the closing process as we now

contingent on the property being subdivided. As everyone proceeded towards
closing, no one knew that the property was in an <strong><span style="font-family: "Arial","sans-serif";">Agricultural and Forestal District</span></strong>
or "AFD" for short. <o:p></o:p></span>

<div style="background: white; margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;"></span><br />
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">AFDs are
rural conservation zones established voluntarily by landowners with their local
government (county or in some cases city or town) to conserve, protect, and
foster the development and improvement of lands for the production of food and
other agricultural/forestal products. AFDs have restrictions about development
and subdividing the lands within the districts. <strong><span style="font-family: "Arial","sans-serif";">Information on whether or not a property is within an AFD
is not recorded in the Clerk's Office and therefore not revealed by title work.</span></strong>
This information can usually be found at the county or city community planning
and development office and guidelines and rules for AFDs are likewise found in
county or city Code as well as the Agricultural and Forestal Districts Act of
Virginia established in 1977.<o:p></o:p></span></div>

above scenario the parties found out before settlement that the property was in
an AFD and that it could not be subdivided according to the AFD's strict rules.
But this was only after both the Purchaser and Seller had spent thousands of
dollars in surveying costs, appraisal, and inspections. The deal died in the
end.<o:p></o:p></span></div>

the Buyer may have to wait until Tuesday to occupy.<o:p></o:p></span></div>

Clerk's offices may refuse to record a deed or other document if the last names
are not differentiated by capitalization or an underscore from the first name.
So, the first name may be lower case, and the last name upper, like this: John
DOE. Or, if both the first and last names are capitalized, the last name must
also be underscored, like this: JOHN <u>DOE</u>. This only applies to deeds and
documents recorded without a cover sheet.<o:p></o:p></span><br />

King, Jr., Day. (All banks and government offices will also be closed on Martin

expired at the end of 2013. Included in the tax breaks is the Mortgage Debt
Relief Act or Debt Forgiveness Act. On December 16<sup>th</sup>, the tax breaks
passed the Senate and the President sign the bills. The
retroactive extension goes back to January 1, 2014. <o:p></o:p></span><br />

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">The Debt Forgiveness Act helps
homeowners who either experienced a short sale or a foreclosure. When a
Borrower sells his home for less than what is owed, the bank may agree to
forgive the deficiency. Normally, the debt that is forgiven is taxable as
ordinary income. If the forgiven debt meets certain conditions, with this tax
break, there will be no taxable income to the Borrower who has just lost or
short sold his home.<o:p></o:p></span></div>

notice from "Virginia Council for Corporations." <o:p></o:p></span><br />

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">An entity is posing as the
Virginia State Corporation Commission and is attempting to solicit money from
companies and corporations. The entity sends official looking notices to
companies and requests $125 to file annual reports that go to the State Corporation
Commission.<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">The SCC has received numerous
inquiries regarding the notices and has even posted an alert on their website.
According to the SCC, "A search of the Commission's business entity
records in the Clerk's Office revealed no information about a company with the
name Virginia Council for the Corporations."<o:p></o:p></span></div>

agent since Central Virginia has practices that are different from other
localities around the Commonwealth.<o:p></o:p></span><br />

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Here's a hypothetical scenario
that highlights some of the issues that can arise when a Purchaser uses an out
of state settlement agency:<o:p></o:p></span></div>

<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">1. The seller's closing
paralegal advises the buyer's out of state closing agent in writing about
Central Virginia closing procedures, namely that seller's side needs a wire for
all seller side disbursement prior to releasing the deed. The closing paralegal
provides these closing procedures to the buyer's side a full THREE weeks before
closing. The buyer's agency agrees to close the Central Virginia way.<o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">2. On the day of closing (a
Friday), the buyer's side suddenly refuses to close the Central Virginia way.
The seller's side contacts the senior title underwriter, and a compromise is
reached. But not for long...<o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">3. The local agency of the
actual Title insurer refuses to budge. They insist on making all seller
disbursements post recordation. The out of state settlement agency threatens to
return the lender's wire, stating that the closing will just not occur. The out
of state agency requests that the seller's side UPS/FedEx the original Deed from
Virginia to their out of state office so that it can be "processed"
and mailed back to record in the local clerk's office.<o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">4. The seller's side offers
to facilitate the transaction, i.e., sit with the buyer for closing, supply a
conference room, update title, and record. The buyer's side does not accept the
offer and sends a traveling notary to meet the buyer at the property to sign
closing docs. <o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">5. The traveling notary is
late.<o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">6. The day of closing
passes...<o:p></o:p></span></div>

<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">7. Negotiations continue
into the next week. It makes no sense and does not protect the Seller to send
the executed Deed out of state without any guarantee as to when or if the sales
proceeds will be paid to the Seller. Just when it seems as though no compromise
will be met, the closer from the buyer's agency calls the seller's closing
paralegal and asks if she will be willing to record and update. The buyer's
closer says she will send all seller disbursement except the payoff but will
send confirmation of payoff immediately after recording and sending her wire.
Buyer's closing agent agrees immediately as it is now Tuesday afternoon of the
next week.<o:p></o:p></span></div>
<br />
<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">8. The Deed is finally
recorded Wednesday. Also, the Seller's loans were paid off a full week after
closing, adding several days' additional interest.<o:p></o:p></span></div>

convoluted, use it as a reason to encourage buyers to use local settlement

was mailed directly to the listing realtor from the out of state settlement

regulated by state law and local practices which protect both the Buyer and the
Seller. In the vast majority of the Commonwealth, the Purchaser's settlement
attorney or settlement agent disburses all the proceeds from the transaction.
The Seller is basically unrepresented.<o:p></o:p></span><br />

<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">In Central Virginia, our local
practice results in actual representation for the Seller. As a result, the
Seller's attorney or Settlement Company disburses the Seller's proceeds
including pay off of the mortgage and real estate commissions. Our local bar
has procedures in place which allow this to occur while still protecting the
Purchaser.<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Unfortunately, whenever a lawyer
or settlement company from outside our area is hired to represent the
Purchaser, a major issue occurs. The Purchaser's non local settlement agent,
unfamiliar with our practices, insists on the closing occurring their way. This
may mean that someone unfamiliar with our local practice demands to record and
disburse all the proceeds. Not only is there no protection for the Seller, but
the use of an out of the area settlement company may result in several days
delay in recording the Deed and paying the mortgage and realtor. <o:p></o:p></span></div>

<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">It makes no sense for an out of
state title company to insist that the Purchaser meet a traveling notary at a
fast food restaurant to sign closing documents. It also makes no sense to send
an original deed to an out of state agency so it can be "processed"
only to have it mailed back to record in a local Clerk's office. Yet, all of
those requests are possible when dealing with an out of area settlement agency.<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Rather than deal with the
potential headache of arguing over who will be disbursing funds and rather than
deal with potential delays in the closing, strongly encourage Purchasers to use
a local settlement agent. There are a number of excellent real estate attorneys
and settlement companies in the Central Virginia market. The time involved and
problems caused in requiring the settlement agent to follow our local practices
is not worth all the problems caused. <o:p></o:p></span></div>

informed that when an REO seller like Fannie Mae or Freddie Mac offers Free
Title Insurance to the buyer, the title insurance is not the best deal for the
buyer. The buyer may incur additional title expenses (title search fee, binder
fee, copy charges, and a lender's title insurance policy). Additionally, the
buyer will be required to use the REO seller's non-local settlement agency who
may not have the buyer's best interest as their primary goal.<o:p></o:p></span><br />

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Tucker's Tip recommends that REO
Purchasers select their own settlement agency or real estate attorney and elect
to purchase their own title insurance. Tucker's Tip also recommends that the
contract state that closing cost credit will include among regular closing
costs and prepaids the cost of the title insurance. REO sellers who offer
"free" title insurance will often not allow the closing cost credit
to go towards the cost of title insurance if the buyer chooses his own
settlement agent. Accordingly, the contract should explicitly state that if the
buyer selects his own title insurance, the cost will still be included in the
closing cost credit. <o:p></o:p></span></div>

one item that proves particularly helpful is a Home Warranty. Warranties vary
with price and coverage, but a typical Home Warranty costs around $400-500 and
covers electrical, mechanical, and plumbing systems in a home as well as the
appliances and the HVAC system. Optional coverage can be purchased for
additional costs in order to cover items like pools or hot tubs. Minimal
deductibles may exist.<o:p></o:p></span><br />

from the date of the listing and helps protect the Seller if something happens

Buyer then obtains the balance of the Warranty (usually lasts two years from
the initial purchase). <o:p></o:p></span></div>

for a Home Buyers Warranty with coverage beginning on the closing date and

with a closing is to make sure that the Well and Septic reports are ordered in
a timely manner. The listing realtor knows to order these reports within thirty
days of the closing, but if the reports are ordered too close to the closing
date, another problem could potentially arise. <o:p></o:p></span><br />

<div style="margin: 0in 0in 0pt;">
<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">If the well needs to be treated,
there is an automatic 3-4 day delay until the well can be chlorinated and then
re-tested. <b>As a good practice tip, if the house has been empty for a while,
go ahead and chlorinate the well now</b>. Then, when the report is ordered for
the closing, the well will probably pass the first time.<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">The normal septic inspection does
not usually cause a delay, but there are those occasions where a problem is
found. A delay could occur while the septic tank is dug up and inspected. <b>As
another good practice tip, the Listing Agent could ask the Seller when was the
last time the septic tank was pumped</b>. If the tank was recently cleaned,
obtain a copy of a report to provide to the Purchaser. If (as is more likely)
the Seller cannot remember when the septic tank was last pumped, suggest that
it be pumped now.<o:p></o:p></span></div>

lenders may accept contracts with e-signatures. However, if a power of attorney
will be used as part of the settlement, docu-signatures are not acceptable.
With a docu-signature, there is no record of an original signature. As a
result, if a power of attorney will be used, make sure to obtain wet signatures
on the contract; otherwise, there could be a delay in closing. This need for
wet signatures also applies for subsequent contract addendums. Be sure to check
with the specific lender so that the exact requirements are understood and
communicated to all parties.<o:p></o:p></span></div>

seems to suggest that short sellers now have to wait four years after a short
sale to obtain certain types of mortgages while those who go through a

on the type of loan and the down payment. We all know short sales can be very
difficult to complete, they are better than a foreclosure for the specific
neighborhood and the general real estate community. The advantages of short

If the last day of the month falls on a Friday, it is entirely possible that the closing may not be completed by the end of the day. For example if the well needs to be treated, there is an automatic 3-day delay. If the Seller has an FHA loan to pay off, any delay in closing may result in the loan payoff increasing by an additional month of interest.</span></div>

and endless negotiations. Negotiations can become even more complicated if
there are subordinate lienholders or if there is a service transfer of the

finally issues the approval, all parties experience a sense of relief. However,
the question remains: is the Purchaser ready to close?<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Most short sale approval letters
only provide a 30 day window for the <a href="http://www.tgblaw.com/practice-areas/real-estate/real-estate-short-sales/">closing</a>. If the closing does not happen by
the deadline, the negotiator has to ask the short sale lender for an extension.<o:p></o:p></span></div>

<span style="color: black; font-family: "Arial","sans-serif"; font-size: 10pt;">Unfortunately, extensions are not
always given. The lender may request new financial documents from the seller, a
new BPO may be ordered, or the lender may even ask for a per diem for any
extension. Accordingly, the Purchaser needs to be ready to close within the
"30 Day Window" given with the original short sale approval letter.<o:p></o:p></span></div>

home inspection already completed and the loan application started well before
